I. Regulations

This section contains the general regulations applicable to any person – individual or legal – who accesses the website www.powerd.eu. By accessing the www.powerd.eu website, it is automatically considered that the terms and conditions, as explained below, have been acknowledged and accepted without reservation.

The terms and conditions are imposed by the administrator of the www.powerd.eu website and may be changed at any given time, without prior notice to the user and without their consent. Any time the user is accessing the website, the "Terms and Conditions" section will be available for reviewing the terms and conditions in force at the moment.

 

II. Sharing content on social networks

Any content found on the www.powerd.eu website can be shared on Facebook, automatically, by using the integrated button. V. User Rights

The user should use the website www.powerd.eu while being aware of the full responsibility for the information submitted.

1. Right to access

The user has the right to obtain, from the administrator of the website, a confirmation of the possible processing of their personal data, and at the same time they have the right to obtain access to that particular data.

2. Right to rectification

The user is entitled to obtain, from the administrator of the website, without undue delay, the rectification of their inaccurate personal data. Given the purpose for which the data were processed, the user has the right to request the completion of incomplete personal data - including by filling in an additional statement.

3. Right to delete data

The user has the right to request and obtain the deletion of their personal data, without undue delay, if such data are no longer required, if the consent to use has been withdrawn and there is no legitimate ground for processing, or if the user opposes the processing of the data and there is no reason to continue such processing, or if the data has been illegally processed.

4. Right to restrict processing

The user has the right to obtain restriction of the processing of their personal data in the following situations:

- disputes the accuracy of the data used over a certain period of time what can still be verified by the website administrator;

- data processing is illegal and the user does not agree with the deletion of their personal data, but instead calls for restriction of use;

- user data is no longer required for processing, but the user explicitly requests them in order to find, exercise, or defend a right in court;

- opposes processing for the time span needed to check whether the rights of the website's administrator overlay the user's rights.

5. Right to withdraw the consent

The user may withdraw their consent to the processing of their personal data at any given time, without this withdrawal to operate retroactively and affect previous actions. Withdrawal of the consent is made exclusively by written request addressed to the website administrator, sent by e-mail to info@powerd.eu.

6. Right to oppose

The user may oppose the processing of their personal data at any time, with recurrent impact, if the processing of the data is of public interest or is based on a legitimate interest of the provider. If the user opposes the processing of their personal data, the website administrator will cease processing, if there is no legitimate reason for any further processing.

7. The right to data portability

Upon request, the user may have access to their personal data in a structured, readable format. Without any obligation to the webmaster of www.powerd.eu, the user may transmit their personal data to another operator, if the processing is done automatically, with the consent of the user.

8. The right to lodge a complaint to a supervisory authority

The user has the right to file a complaint to a supervisor having jurisdiction over their domicile / headquarters or the supervisory authority under whose jurisdiction our website is located:

9. The right to a judicial remedy against a supervisory authority

The user has the right to appeal to the court of the supervisory authority concerned, inclusively in the situation where the authority does not submit a resolution within three months from the moment the complaint was filed.

10. The right to a judicial remedy against an operator

The user has the right to appeal to the court if they consider that their rights have been violated as a result of the processing of personal data.

In case of a breach of personal data security, the administrator of www.powerd.eu will notify the competent supervisory authority without undue delay.

If the user has questions about data protection or about exercising their rights or in case there are strong reasons for making a complaint, they can contact the administrator of the website www.powerd.eu, by email: info@powerd.eu.

 

VI. Inaccountability clause

POWER DESIGN Srl is not responsible for the correctness of the data published on the pages of the website www.powerd.eu. Users of the website www.powerd.eu take full responsibility for the content of the published materials, and POWER DESIGN Srl cannot be held accountable for the content and / or veracity of the information posted by users.

POWER DESIGN Srl does not guarantee that the website www.powerd.eu is free of viruses or other potentially harmful electronic components. The user accesses this website at their own risk, POWER DESIGN Srl being free of any liability in the event of any direct or indirect damages caused by accessing the pages on the website.

It cannot be guaranteed that the website www.powerd.eu will be available continuously. The administrator is not responsible for any interruptions of the displaying of pages on the www.powerd.eu website for reasons beyond its control, nor for any damages or inconvenience caused to the user for this reason.

VIII. Applicable law

The legal reports underlying this document are subject to the legislation in force in Romania, especially to OG nr. 21/1992 on consumer protection, Law nr. 365/2002 on electronic commerce, OG nr. 130/2000 on consumer protection in the conclusion and execution of distance contracts and Law 677/2001 for the protection of individuals with regard to the processing of personal data.

Any litigation related to a dispute arising out of these terms and conditions that cannot be settled amicably will be settled by the competent courts in Cluj-Napoca, competency which the user automatically accepts by accepting these terms and conditions.

Changes to the terms and conditions

Terms and conditions can be changed at any time, as new situations of any nature may require it. The administrator will ensure uninterrupted, permanent access to the terms and conditions of use of the website, without prior notice to the users of the changes that have occurred.

1. What is a cookie?

Cookies are currently used by almost all websites. A cookie is a small text file, consisting of numbers and letters, that is stored on any electronic device that accesses websites (mobile phone, computer, tablet etc.).
